Information for Business Partners of MAKINO Europe GmbH, MAKINO GmbH and Customer Support Technologies GmbH and for Other Individuals Regarding the Processing of Their Personal Data


MAKINO Europe GmbH, MAKINO GmbH and Customer Support Technologies GmbH are committed to protecting the privacy of their business partners and other individuals whose personal data is processed. This is carried out in accordance with the General Data Protection Regulation ("GDPR") of the European Union.
 
Business partner” refers to any natural person with whom MAKINO Europe GmbH, MAKINO GmbH or Customer Support Technologies GmbH has a business relationship, in particular representatives and employees of customers, suppliers, service providers, partners, and competitors. The purpose of this information is to inform business partners in Europe about the purposes and scope of the processing of their personal data by MAKINO Europe GmbH, MAKINO GmbH and Customer Support Technologies GmbH and to advise them of their rights.

II. Purposes and Legal Bases for the Use of Your Personal Data
 
1) The processing of personal data is carried out for the purpose of fulfilling contracts with individuals (natural persons) with whom we maintain business relationships, for example, for the execution of purchase orders, deliveries or payments, in connection with complaints, repair or maintenance work, or in warranty cases. It is also carried out for the preparation of quotations or the response to quotation requests from individuals, for determining the terms of the contractual relationship, and in relation to product development activities (Article 6(1)(b) GDPR).
 
2) Furthermore, the controller is subject to various legal obligations (Article 6(1)(c) GDPR) that may require the processing of your personal data. These legal obligations may arise, for example, from tax regulations, foreign trade laws, or sanctions regulations.

3) The processing of your personal data also takes place where necessary to protect our legitimate interests in accordance with Article 6(1)(f) GDPR, including:
  • for the conclusion or performance of contracts and other business relationships, as well as in relation to product development activities, with our customers, suppliers, service providers, and competitors, for whom you may act as a representative or employee;
  • for the internal transfer of your personal data within the company for administrative purposes (e.g. accounting);
  • to ensure information security;
  • to prevent criminal offences;
  • to conduct compliance investigations;
  • to ensure the security of buildings and facilities; if this includes video surveillance to protect our business premises, affected individuals will be informed separately;
  • for the general maintenance of our customer relationships;
  • to send you product- and/or service-related promotional information and to inform you about special company events. When processing your contact details for this purpose, we assume that, due to your industry affiliation or previous contact with us, there is an interest in our products and services.
You may object to the processing of your personal data for the protection of legitimate interests at any time; for further details, please refer to section V.

4) We also process your personal data where you have given your consent in accordance with Article 6(1)(a) GDPR, for example, when sending our newsletter. You will only receive our newsletter if you have registered for it and have additionally confirmed your subscription separately. You can unsubscribe from the newsletter at any time by clicking the designated link in the newsletter (withdrawal of your consent).
 

III. Recipients of Your Personal Data

Within the company, only authorised employees of MAKINO Europe GmbH, MAKINO GmbH and Customer Support Technologies GmbH with the relevant responsibilities have access to your personal data.
 
We are entitled to engage third parties, such as IT service providers, legal advisors, tax consultants, or business consultants, to provide services on our behalf, under our supervision, and in accordance with our instructions. These third parties may have access to your personal data to the extent necessary for the performance of their services.
 

IV. Data Transfers

For the purposes outlined in Section II, your personal data may be transferred not only to MAKINO Europe GmbH, MAKINO GmbH or Customer Support Technologies GmbH, which are the contracting parties and, together, the controller responsible for processing your personal data, but also to other companies within the MAKINO Group and their service providers, both within and outside the European Economic Area (EEA).
Furthermore, personal data processed for marketing purposes is transferred to a cloud operated by the U.S.-based software provider Salesforce. However, this cloud is hosted within the European Union.
 
Countries outside the EEA may have different data protection regulations compared to your country of residence. In the event of a transfer of your personal data to other countries as described above, we will take appropriate measures to ensure the adequate protection of your personal data in those countries. In particular, we have concluded or will conclude appropriate agreements with these data recipients, which, where necessary, include the EU Standard Contractual Clauses.
 

V. Your Rights

In accordance with the legal provisions set out in Articles 12 to 23 of the GDPR, you have the right to obtain free access to the personal data stored about you, request the correction of inaccurate data, and demand the deletion or restriction of processing, as well as the portability of your personal data. You also have the right to object to the use of your data for direct marketing purposes at any time with effect for the future. Additionally, you may object at any time, with effect for the future, to the processing of your data based on legitimate interests under Article 6(1)(f) GDPR if reasons arise from your particular situation. You can submit your objection in writing at any time or send it by email to [email protected].

Consent is voluntary. You may refuse to give consent without providing any reasons and without suffering any disadvantages as a result. If you have given consent, you may withdraw it at any time in writing or by email to [email protected]. Withdrawal of consent does not affect the lawfulness of the processing carried out based on your consent before its withdrawal. 
 

VI. Confidentiality and Data Storage
 
Each of our employees, as well as all employees of external service providers who have access to and/or process personal data, are obliged to treat this data confidentially. In addition, we have implemented the necessary technical and organisational measures to ensure confidentiality and require our service providers to comply with these measures as well.
 

VII. Deletion

The personal data collected will be stored until the expiry of the statutory retention period, which is generally 10 years under the Commercial Code and the Fiscal Code (Article 6(1)(c) GDPR), and will then be deleted unless you have given consent for extended storage under Article 6(1)(a) GDPR or the purpose of the data processing has not yet ceased. In such cases, the personal data will be stored until the purpose no longer applies and will then be deleted.
