Information for business partners of MAKINO Europe GmbH and MAKINO GmbH in Europe on the processing of their personal data
MAKINO Europe GmbH and MAKINO GmbH are committed to protecting the privacy of their business partners when processing their personal data. From late May 2018, the EU General Data Protection Regulation (
GDPR) will set new standards of data protection within the European Union.
“
Business partner” means any natural person who maintains a business relationship with MAKINO Europe GmbH and/or MAKINO GmbH, in particular representatives and employees of customers, suppliers, service providers, and competitors. The purpose of this communication is to inform business partners in Europe about how MAKINO Europe GmbH and MAKINO GmbH process their personal data.

II. Use of your personal data
We process your personal data if this is necessary for the purposes of the
legitimate interests pursued by us (Article 6(1)(f) of the GDPR), in part
- to conclude or execute contracts and other business relationships (to include the handling of purchase agreements, deliveries, or payments, in connection with complaints and repairs/servicing or guarantee claims), or to prepare or reply to requests for quotations, to lay down the conditions of a contractual relationship, and with regard to product development activities, in each case with our customers, suppliers, service providers, and competitors for whom you may act as a representative or employee
- to transmit your personal data within the company for internal administrative purposes (e.g. accounting)
- to ensure effective IT security
- to prevent offences
- to perform compliance reviews
- to ensure building and plant security (this includes CCTV where required to protect our business premises)
Personal data are also processed for the purpose of
fulfilling contracts with individuals (natural persons) with whom we maintain a business relationship, e.g. to handle purchase agreements, deliveries, or payments, in connection with complaints, repairs/servicing, or guarantee claims, or to prepare quotations for and reply to requests for quotations to individuals, to lay down the conditions of a contractual relationship, and with regard to product development activities (Article 6(1)(b) of the GDPR).
The controller is subject to a range of
legal obligations (Article 6(1)(c) of the GDPR) that may make it necessary to process your personal data. These legal obligations may arise, for example, from regulations existing under legislation relating to tax, foreign trade, or sanctions.
III. Recipients of your personal data
Within the company, only authorised employees of MAKINO Europe GmbH and MAKINO GmbH with corresponding responsibilities have access to your personal data.
We are authorised to contract third parties such as IT providers, legal advisers, or management consultants to provide their services on our behalf, under our supervision, and in accordance with our instructions. These third parties may be given access to your personal data if this is required for them to provide their services.
IV. Data transmission
For the purposes set out in section II., your personal data may be transmitted not only to MAKINO Europe GmbH and MAKINO GmbH, which is the contracting party (and the controller responsible for processing your personal data), but also to other companies in the Makino group and their service providers within and outside the European Economic Area (EEA).
Countries outside the EEA may be subject to data protection regulations that differ from those in force in your country of residence. If your personal data are transmitted to other countries as set out above, we will take adequate precautions to ensure that your personal data are adequately protected in these countries. In particular, we will conclude or have concluded corresponding agreements with these data recipients that contain the EU standard contractual clauses.
V. Your rights
You have the right to obtain information on your personal data and to request the rectification or erasure of your personal data or a restriction of their processing, provided this is permitted under applicable legislation.
You have the right to object to any form of personal data processing as set out in section II., and to request your personal data in a structured, commonly used, and machine-readable format (data portability), in accordance with applicable law and subject to a legal review of each specific case by the controller of your personal data. You also have the right to lodge a complaint with a supervisory authority.

All of our employees and all employees of external service providers who have access to personal data and/or process personal data are obliged to treat these data confidentially.
